15/11/2007 Trepashkin to be released on December 1
The Sverdlovsk Regional Court has stated that the imprisonment term of Mikhail Trepashkin, ex-FSB lieutenant colonel, expires on November 30 this year. By doing so, the Court has partially satisfied the inmate's cassation complaint demanding to cancel the decision of the Nizhni Tagil District Court to toughen his custody conditions and extend his term till December 19.
The "Caucasian Knot" correspondent was told about it right after passing the verdict by Gleb Edelev, coordinator of the Ekaterinburg Movement against Violence, who was present in the courtroom.
"It turned out that Dmitri Ilyutik, judge of the Tagilstroy District Court of Nizhni Tagil, had passed his ruling to extend Mikhail Trepashkin's term only on the basis of a certificate submitted by the administration of the corrective colony. The court had failed even to consider the grounds for such decision," Gleb Edelev has explained.
Also, the Court has recognized today the decision of the Nizhni Tagil judge to put Trepashkin, till enactment of the court ruling about his transfer to another custody mode, into the premise that functions in the mode of a pre-trial facility, located in Corrective Colony No. 13, to be illegal.
At the same time, as the "Caucasian Knot" has already informed, the Sverdlovsk Regional Court has confirmed the decision of the first instance court to transfer the inmate from the settlement colony into a general-mode colony, that is, into a tougher custody. This was demanded by the CC-13 administration, which had asserted that Trepashkin was maliciously breaking the internal regulations of the corrective establishment.
