2.11.2007 22:32 MSK Constitutional court tosses out complaint Vadim Prokhorov, Vladimir Bukovsky and Vladimir Kara-Murza Vadim Prokhorov, Vladimir Bukovsky and Vladimir Kara-Murza RUSSIA, Moscow. On November 1, the Constitutional Court of Russia determined it would not examine the complaint of SPS (Union of Right Wing Forces) member and journalist Vladimir Kara-Murza. The applicant requested that the court examine the Russian Constitutional law passed in July of last year, in accordance with people with dual citizenship were forbidden from being elected to the Parliament of Russia and the legislative assemblies of the Federation, and were also prevented from becoming President of the country and from holding other high state offices.
The judicial session was conducted in private. Murza's official representative in the Constitutional Court Vadim Prokhorov was not even allowed in the room. The detailed motivation for refusing to examine the complaint is unknown. Prokhorov expects to obtain a letter from the Constitutional Court with an explanation in 1-2 weeks.
Statute 32 of the Russian Constitution guarantees the right to election into state and local positions to all citizens of Russia with exception of persons found by the courts to be incompetent and those sentenced to deprivation of freedom.
On April 27 Vladimir Kara- Murza filed a complaint with the Constitutional Court, in which he indicated that the law passed last year violates not only St.32 of the Russian Constitution, but also Article 55, which forbids the enactment of legislation that abolishes or diminishes the rights of citizens and Article 6, which calls for equal rights for the citizens of all Russia' territories.
The prohibition of persons with dual citizenship from running for President of Russia may soon be used against Vladimir Bukovsky, who is planning on being a candidate in the next presidential elections, in March 2008.
