Prosecutor’s Office of Kabardino-Balkaria insists that illegal methods of investigation have not been applied to Rasul Kudaev, who is under investigation
KABARDINO-BALKARIA, 20 January, CaucasusTimes. Yurii Ketov, Prosecutor of Kabardino-Balkaria replied to the report in defence of Rasul Kudaev, who is currently under investigation, which has been sent earlier by human rights activist Svetlana Kudashkina and lawyer Irina Komisarova.
The reply says that Rasul Kudaev has been detained “as a suspect in the criminal case # 25/78-05, started on 13 October 2005 in connection with the attack on law enforcement agencies and civil objects in Nalchik. On 25 October 2005 Nalchik city court decided to take Kudaev into custody.
On 22 November Kudaev was accused of committing crimes in accordance with the article 205 (terrorism), article 317 “e”, “z”, part 2 of the article 105, part 2, article 209, part 3, article 222 of the Russian Criminal Code.
Prosecutor explained that physical injuries could have appeared as a result of ”excessively tight handcuffs”. Apllication of physical methods to Kudaev, in Prosecutor’s opinion, corresponds to the articles 13 and 14 of the Russian law “On Militsia”.
Prosecutor ended his reply by asking Gannushkina to provide him with all available information on applying physical violance against Kudaes which she is aware of.
Rasul Kudaev is a former prisoner of American prison in Guantanamo where he was transporeted in 2001 from Afghanistan. In 2003 he was transported to Russia where he was accused of illegal crossing the border, organizing criminal group and hireling. However, those accusations were not supported by evidences and in June the same year Kudaev was released.
The last detention of Kudaev, who, according to his neighbors, was at home during the attack on Nalchik and therefore could not participate in terrorist activities, could be explained by the intention of law enforcement agencies to show international character of the 13 October events.
