The Committee against Torture is investigating a matter brought by T. Khnychkova. Her son, Vadim Khnychkov, was convicted in July 2005 for serious crimes. The sentence has not yet begun, and Khnychkov is being held in IZ-52/1. Khnychkova reported that during his time under guard, the police repeatedly applied violence to her son in order to force him to acknowledge his part in the crimes.
Khnychkov was so gravely injured, that he could not move, according to a Nizhny-Novgorod Committee Against Torture communication on November 24th.
The basis for the charges in Khnychkov’s case were obtained under torture.
An attorney collaborating with the Committee Against Torture, questioned Khnychkov in prison. He confirmed that law enforcement agents applied violence and that he repeatedly went for medical aid to the medical-sanitation section of SIZO, but was not given aid, and his visits were not recorded.
The Committee Against Torture repeatedly approached the Procuratorship about Khnychkov. The Procuratorship, after conducting an investigation, came to the conclusion that there was no violation of the law. The Procuratorship asserts Khnychkov had no injuries and did not request medical aid. Vadim Khnychkov stated that the administration of SIZO did not record his request for medical aid, but the Procuratorship did paid no attention to this. It is not possible to consider the report complete or objective as the Procuratorship did not consider it necessary to talk to Khnychkov.
On November 22nd, T. Khnychkova contacted the Committee against Torture and reported that her son was severely beaten by a SIZO officer, and had previously been unjustifiably placed in a punishment room. On November 23rd, at the urgent demand of the Committee Against Torture, an attorney arrived in SIZO, and demanded a physical examination of Khnychkov be conducted without delay. The investigation revealed haematomas in the region of chest.
Khnychkov described his abuse to the attorney in detail. Khnychkov’s health is sharply deteriorating. The pressure was increased after he complained about conditions in the prison. The officers of SIZO don’t consider it necessary to hide their reasons for the abuse. In the course of the criminal case, the Nizhniy-Novgorod Procuratorship investigator repeatedly told Khnychkov that, regardless of the court’s decision, they would send him to a colony in the Nizhniy-Novgorod region, where they would drive him to him to suicide or physically destroy him.
